Pain is the leader of Akatsuki but Tobi manipulated his Ideals to do what he wanted to. Now that Pain sacrificed himself to revive all people he killed then Tobi is the leader of Akatsuki. Furthermore, Pain was the founder and leader of akatsuki, not Tobi. Konan said so in the anime.
